1. Introduction

Welcome to Caroset. These Terms of Service ("Terms") generally apply to your access and use of the Caroset website, application, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Acceptance of Terms

By registering for, accessing, or using Caroset, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms constitute a legally binding agreement between you and Caroset regarding your use of the Service.

3. Description of Service

Caroset is a web-based tool designed to help users create, format, and export carousel-style posts for social media platforms. The Service is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

4. User Accounts

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. Caroset cannot and will not be liable for any loss or damage arising from your failure to comply with the above.

5. Subscription and Payments

Free and Paid Plans: Caroset offers both free and paid subscription plans ("Creator Pro"). Specific features and limits for each plan are described on our pricing page.

Billing: If you choose a paid plan, you agree to pay the fees indicated for that service. Payments will be charged on a pre-pay basis on the day you sign up and will cover the use of that service for a monthly or annual subscription period as indicated.

Cancellation: You may cancel your subscription at any time from your account settings. Upon cancellation, you will continue to have access to the paid features until the end of your current billing period.

Refunds: Refunds are handled on a case-by-case basis and are generally not provided for partial months of service, but we aim to be fair and reasonable in resolving any billing issues.

6. User Content

You retain full ownership of the content, text, and images you create or upload to Caroset ("User Content"). We do not claim any ownership rights to your User Content.

By using the Service, you grant Caroset a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your User Content solely as necessary to provide the Service to you (e.g., to render the preview of your carousel).

7. Acceptable Use

You agree not to use the Service to:

• Violate any local, state, national, or international law or regulation.
• Infringe upon the rights of others, including intellectual property rights.
• Upload or transmit viruses or malicious code.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorized access to the Service or its related systems.

8. Intellectual Property

The Service itself, including its visual interfaces, graphics, design, compilation, computer code, and all other elements of the Service (excluding User Content), are protected by copyright, trade dress, patent, and trademark laws. All such rights are the property of Caroset.

9. Third-Party Services

The Service may contain links to or integrations with third-party websites or services (e.g., payment processors like Stripe). We are not responsible for the content, products, or services on or available from those websites or services or links displayed on such websites.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

11. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Caroset makes no representations or warranties of any kind, whether express or implied, regarding the operation of the Service or the information, content, or materials included therein.

12. Limitation of Liability

In no event shall Caroset, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

13. Changes to the Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

14. Governing Law

These Terms shall be governed and construed in accordance with applicable laws, without regard to its conflict of law provisions.
